Mar-A-Lago Top Secret Docs causing deaths

(EDITOR'S NOTE: Adam Moss is widely considered one of the great magazine editors of his generation, remaking and reshaping The New York Times and New York magazine into the most significant print and digital publications of our time.)

The CIA has now traced deaths of U.S. agents and informants to the top secret documents that were openly displayed at Trump’s home. These top secret documents were left literally everywhere at Mar A Lago, including in open boxes in his ballroom for guests and spies to read like magazines at a doctor's office.

These documents are so dangerous to people and our country that they must only be read in special rooms and only by people with the highest clearances.

Yet U.S. District Court Judge Aileen Cannon, the Trump appointee who is the assigned judge in the stolen documents case, is so biased and unqualified that she said this frivolous case should not even come before her, and she is doing whatever she can to delay it until after the November election.

This case, of all the Trump cases, is the most important. No telling how many people will be killed by Trump’s careless actions or how much closer he has brought our country to losing superiority on the battlefield.

On stage for all to see in his large ballroom.

So why would Trump do this? Sociopaths don’t care about others or about consequences, only themselves.

Sociopath: a mental health condition in which a person consistently shows no regard for right and wrong and ignores the rights and feelings of others. Those with these antisocial personality disorders tend to lie, break laws, act impulsively, and lack any regard for their own safety or the safety of others.

Doesn't that sound like Trump?

Given the behavior of judges like Cannon and Supreme Court Justices like Thomas and Alito, our only recourse is to vote Trump and his MAGA Republicans out of office.  If they prevail in the fall elections, there is a very real possibility that you will have no control over your life, your body, your rights, your freedom, your democracy.

MAGA Republicans thrive on obstruction, division, and hate.

A donation to Trump is a donation to his lawyers, not to his campaign. When you give a "billionaire" your money, you are only hurting yourself.

And a vote for Trump or for his MAGA lackeys is a vote against democracy.  Trump has said as much, and we best take him at his word.

It turns out that the upside-down flag flown at Supreme Court Justice Samuel Alito’s Virginia home after the January 6 insurrection wasn’t the only time one of his properties nodded to the election denialism of Donald Trump’s supporters.

The “Appeal to Heaven” flag flew last summer at Alito’s vacation home in New Jersey, according to The New York Times. Also known as the Pine Tree flag, it originated as a symbol of the American Revolution but became a symbol of Donald Trump’s “Stop the Steal” movement—including one carried by rioters at the Capitol building.

Several photos acquired by the Times showed the flag hanging outside of Alito’s residence on Long Beach Island on four separate dates between July and September 2023.

The revelations cast further doubt on Alito’s excuse for flying an upside-down American flag at his home in Alexandria, Virginia, on January 17, 2021: He blamed his wife, telling Fox News that she had hung it upside down “for a short time” after an anti-Trump neighbor hurled insults at her.

Democrats have since called for Alito to recuse himself from cases related to the 2020 election, and introduced a resolution Tuesday to censure the “shameless” justice for what they call “beyond poor judgment,” arguing that Alito had violated the court’s ethics and invited questions about the court’s impartiality.

Supreme Scheme: How Alito and Thomas Are Fueling the Ongoing Trump Coup

Alito’s fingers were far deeper in the January 6th coup attempt than we realized

By thomhartmann

Senator Dick Durbin, chairman of the Judiciary Committee, needs to act.

Supreme Court Associate Justice Sam Alito was just caught red-handed promoting Trump’s fascist “stop the steal” campaign to overthrow the 2020 election and end democracy in America by flying the upside-down flag at his home. He then went on Fox “News” and lied that it was his wife’s fault and that she did it because schoolchildren at a nearby bus stop saw a neighbor’s “F*ck Trump” yard sign.

Morning Digest: Will the DCCC get its candidate in

Oregon tonight?

In fact, as the Lincoln Project’s Steve Schmidt pointed out this past weekend:

“Mrs. Alito was so alarmed by the degradations and profane, yet protected speech that she went immediately home, and inverted the American flag signaling distress. Here’s the problem: there were no school buses and no school children on them in January 2021 in Alexandria, Virginia. Schools in the city were closed for a full year as a result of the pandemic and didn’t re-open until March 2021.”

But Alito’s fingers were apparently far deeper in the January 6th coup attempt than most Americans realize. Trump lawyer Sydney Powell pointed out on Stew Peters’ rightwing YouTube channel that she, Louie Gohmert, and Kari Lake (among others) had filed a lawsuit against Vice President Mike Pence to prevent him from certifying the Electoral College vote on January 6th.

It was a legal attempt to try to do what Trump sent a mob to do when the legal strategy failed:

“We were filing a 12th Amendment constitutional challenge to the process that the Congress was about to use per the Electoral Act provisions that simply don’t jibe with the 12th Amendment to the United States Constitution, and Justice Alito was our circuit court justice for that. Louie Gohmert was the plaintiff in our lawsuit and we were suing the Vice President to follow the 12th Amendment as opposed to the Electoral Count Act.” (emphasis mine)

The 12th Amendment, ratified in 1804, is the provision under which a contested election for president gets thrown to Congress, as happened in the 1876 election where Democrat Sam Tilden got more electoral and popular votes than Republican Rutherford B. Hayes by the first count.

That election ended up thrown to the House because three states had submitted two sets of Electoral College votes (just like Trump’s fake electors), so Congress cut a deal to end Reconstruction in exchange for making Hayes president, even though he arguably lost the election.

The lawsuit, filed by Gohmert, Kari Lake, and a handful of Republican operatives,  demanded the delay so Republicans on the Supreme Court could decide who’d be president, just like they did in the 2000 election. It called for:

“[R]espondent Vice President of the United States to refrain from invoking the dispute-resolution provisions of the Electoral Count Act of 1887 … for the duration of this Court’s consideration of a timely filed petition for a writ of certiorari. As set forth in the argument below, the ECA violates the Electors’ Clause, the Twelfth Amendment, and the Constitution’s structural protections of liberty.”

If Alito would rule that Pence must defer to Congress per the 12th Amendment, the election of 2020 would be thrown to the House with each state having one vote.  There, the presidency would have gone to Trump 27-23, because 27 states’ congressional delegations were then controlled by Republicans.

This was not a brand-new or hastily organized plan. I wrote on March 13, 2020 — eight months before the election — that Republicans I knew in Washington DC had informed me that the Trump folks were planning this exact strategy.

And, sure enough, here it was, with Sam Alito as the inside man.

The invasion of the House chamber by the “stop the steal” traitors was, by the theory of this plan, supposed to delay the counting of electoral college votes at least for a day, to give Alito time to act on the next day, January 7th. He and the courts would then rule that the 12th amendment took precedent to law made since then, Congress would declare Trump the winner, and that would be the end of the discussion.

But Nancy Pelosi got wind of the plot and blew it up by re-convening Congress at 8 pm to count the votes, just two hours after the last of the rioters had left the building and before Alito could rule. As Trump‘s senior attorney Powell told Peters:

“Nancy Pelosi had finagled to file an amicus brief in it — there had been inside goings on in Congress where I believe it was Steve Scalise and [Speaker Kevin] McCarthy [who] kept her from being an actual party; she wanted to work herself inside the case as a party but somehow that didn’t happen — so she got notice when we made our filing because she’d filed an amicus brief.  And then everything broke loose and she really speeded up reconvening Congress to get the vote [count] going, or [Bill Barr’s] Justice [Department] might have issued an injunction to stop it all, which is what should have happened.”

In the end, Alito had to turn down the lawsuit on the morning of January 7th because Congress had already voted to certify the election for Biden.

As a result, we’ll never know how close we came to having a single corrupt Supreme Court justice overturn the election, but that flag flying outside his house gives us a pretty good clue as to what he may well have done the morning of January 7th had Pelosi not quickly acted the previous evening.

But Alito’s attempts to overturn our democracy weren’t limited to his support for Trump’s treasonous acts on January 6th. Were it not for Alito, Clarence Thomas, and at least two other Republicans on the Court, Donald Trump would by now have almost certainly been convicted in federal Judge Tanya Chutkan’s courtroom of seditiously trying to overthrow our government.

That federal criminal case was rapidly moving along when Trump’s lawyers made the absurd assertion that he was immune from prosecution for his attempted sedition because of a brand new, previously unheard of, and totally bizarre, made-up doctrine of presidential immunity. Even Richard Nixon didn’t have the cojones to try that one: he simply admitted his guilt and accepted a pardon to avoid going to prison.

It only takes four members of the Court to grant certiorari, allowing the Court to hear a case: four or more Republicans on the Court went out of their way to give Trump the delay he desperately needed. On February 28th, they granted cert and scheduled oral arguments for the very last day of their 2023-2024 session, the week of April 22nd.

To add insult to the injury to our republic, in oral arguments Alito dropped this little bomb on America, turning the case against Trump inside-out and claiming Trump should get a free pass to crime all he wanted:

“I’m sure you would agree with me that a stable democratic society requires that a candidate who loses an election, even a close one, even a hotly contested one, leave office peacefully, if that candidate is an incumbent?

“All right. Now if an incumbent who loses a very close, hotly contested election knows that a real possibility after leaving office is not that the president is going to be able to go off into a peaceful retirement, but that the president may be criminally prosecuted by a bitter political opponent, will that not lead us into a cycle that destabilizes the functioning of our country as a democracy?

“And we can look around the world and find countries where we have seen this process, where the loser gets thrown in jail.”

Thankfully, at least for the historical record, the Attorney representing Jack Smith’s Justice Department, Michael Dreeben, immediately replied:

“I think it’s exactly the opposite, Justice Alito.”

But Alito, not Dreeben, is on the Court and is the decision-maker. Alito thus gave — and continues to give — Trump a desperately needed further delay by slow-walking his own part of the Court’s decision in the Trump immunity case.

Even if they rule against Trump, which everybody assumed would happen before Alito dropped that rhetorical turd into the proceeding, by giving Donny the delay he wanted, the Republicans on the Court reduced the chance that Trump will ever be held to account for his crimes.

While the Court typically releases their decisions during the summer, they have the option of waiting as long as they want — even until well past the November election date. So, if Trump is elected, he can fire Jack Smith and end the prosecution himself.

And it’s not like Alito and Thomas don’t have a stake in this fight. If Biden is re-elected, by the 2028 election Alito will be 78 and Thomas 80. Insiders have speculated that both would like to retire soon and have their replacements appointed by a Republican president.

"Coke Can" Clarence Thomas: "Look, my hands are clean.  Not a single pubic hair anywhere."

Senile Trump gives NRA fear-mongering speech bookending a 30-second blank-out

no image description available
Donald Trump speaking during the NRA's annual meeting on May 18, 2024, in Dallas, Texas.

Also brags about ending Roe v. Wade, compares himself to Al Capone

By Mark Sumner

Donald Trump suggested that he might run for three terms during his visit to Dallas, Texas, this weekend to speak at the National Rifle Association’s annual meeting.

The NRA awarded Trump its endorsement as he went on stage. He delivered his usual rambling, non sequitur fest by comparing himself to Al Capone, talking about his inherited “genius,” and bragging about how he ended Roe v. Wade. Trump also shared a good amount of fear-mongering, claiming that President Joe Biden had eroded gun rights but failing to give any examples.

But the most impressive part of Trump’s speech has to be when he didn’t say anything for 35 seconds. The teleprompter froze, and so did Trump—as the creepy theme song of QAnon played for the gun-loving audience.

It certainly looked like Trump, deprived of his teleprompter, simply stared around the stage looking for something to say until the words started to roll again, which is how Biden’s campaign is taking it. But Trump sent an angry message on his social media platform claiming that he hadn’t frozen up, saying it was just a “musical interlude” inserted into the middle of a sentence. He then claimed that this is a regular feature of his speeches. Except that it isn’t.

Trump’s campaign also used his NRA appearance to roll out something called “Gun Owners for Trump,” which it claims is being created in response to what Trump called “the violent migrant crime wave that Joe Biden has unleashed on our country,” which might be the most obvious lie that Trump and Republicans are pushing this cycle, as violent crime has actually fallen sharply.

Meanwhile, Texas Gov. Greg Abbott gave a speech during the meeting that actually told the truth.

"Trump's election depends on the extraordinary effort by the NRA," he said

Failed Republican candidate Kari Lake delivered a speech that issued a threat about 75 million "card-carrying members" of the NRA backing Trump.

But the truth is that NRA membership is crashing after losing more than one million members. The NRA is riddled with corruption, from the former CEO and  Executive Vice President Wayne LaPierre treating the organization like a busted piggy bank to new leadership getting caught up in a cycle of infighting.

Trump and his Republicans still feel the need to bend the knee to the NRA, who they’re counting on to pull them through this election cycle. But if the NRA is weaker than it has been in ages, what does that say about the GOP?

It’s time for the Senate to do something about Supreme Court corruption

no image description available
Sen. Dick Durbin, Democrat of Illinois, issued a statement Thursday calling on Justice Samuel Alito to recuse himself from Supreme Court cases on the 2020 election and the Jan. 6 insurrection.

By Joan McCarter

Daily Kos Staff

Senate Judiciary Committee Chair Dick Durbin issued a sternly worded statement Thursday calling on Supreme Court Justice Samuel Alito to recuse himself from cases involving the 2020 election and the Jan. 6 insurrection. The New York Times reported that an upside-down American flag was seen flying at his home for several days following the attack on the Capitol.

This follows a similar call from Durbin for Justice Clarence Thomas to recuse himself on these issues, and it will probably be heeded by Alito as much as it was by Thomas: not at all.

Enough talk, Mr. Durbin. It’s time to do something.

“The court is in an ethical crisis of its own making, and Justice Alito and the rest of the court should be doing everything in their power to regain public trust,” Durbin said in a statement Friday. “Flying an upside-down American flag, a symbol of the so-called ‘Stop the Steal’ movement, clearly creates the appearance of bias.”

While all of that is true, it will likely  be ignored by Alito and the one person who nominally has the power to enforce the court’s toothless code of conduct: Chief Justice John Roberts. Roberts already failed to rein in Alito during a separate recusal demand in which Alito had been gifted an op-ed by The Wall Street Journal, a clear conflict of interest.

It’s time for Durbin to make a very big stink about Alito’s—and Thomas’—blatant abuse of ethics and debasement of the Supreme Court with public hearings.

That includes enforcing the committee’s subpoena  issued to Leonard Leo, founder and former director of the Federalist Society and—thanks to multimillion-dollar campaigns in support of his hand-selected right-leaning nominees—the architect of the current conservative majority on the Supreme Court.

Last fall, the committee authorized subpoenas to Leo and Harlan Crow, a Texas billionaire and Thomas benefactor, which took months to be issued. When it finally happened last month, Leo said that he would refuse to comply.

“Mr. Leo has played a central role in the ethics crisis plaguing the Supreme Court and, unlike the other recipients of information requests in this matter, he has done nothing but stonewall the committee,” Durbin said.

Durbin added that Leo's "outright defiance left the committee with no other choice but to move forward with compulsory process."

Then do it.

Instead, Durbin has been spending energy on plotting a bipartisan agreement on the blue slip process for appeals court nominees that gives home-state senators veto power over judicial nominations. It’s been a political process abused by Republicans since the Obama administration, and, as it stands now, Durbin is moving appeals court judges without blue slips but has retained the practice for district courts.

And sure enough, Republicans like Missouri Sens. Josh Hawley and Eric Schmitt are blocking President Joe Biden’s nominees. That just demonstrates that a bipartisan agreement wouldn’t even be worth the paper it’s written on.

It’s time for Durbin to start focusing on how to save our democracy from a corrupt Supreme Court.

The five traitor justices who are destroying the integrity of the judicial branch of our democracy one perfidious decision at a time.

ALDOUS J. PENNYFARTHING: Trump promises to destroy Earth if Big Oil execs give him $1 billion

It's the Second Coming alright...of SATAN!

By Aldous J. Pennyfarthing for Community Contributors Team

Daily Kos

The next time a MAGA tries to convince you the Biden family engages in influence peddling, show them this story. Just as Donald Trump plotted to withhold congressionally approved money for Ukraine unless its president did him “a favor,” he’s now vowing to make the fossil fuel industry’s pre-apocalyptic dreams come true. All he needs in exchange is a $1 billion cash infusion to his campaign.

Assuming you’re not Rep. James Comer—who’s so into Trump, the producers of “The Human Centipede” franchise have a viable case for trademark infringement—it’s clear that the kinds of things Republicans are falsely accusing President Joe Biden of doing are the very things that Trump does all the time … and openly. And, indeed, he’s so openly corrupt, he’s barely trying to hide it anymore.

To wit, this frosty mug of what-the-fuck from The Washington Post:

As Donald Trump sat with some of the country’s top oil executives at his Mar-a-Lago Club last month, one executive complained about how they continued to face burdensome environmental regulations despite spending $400 million to lobby the Biden administration in the last year.

Trump’s response stunned several of the executives in the room overlooking the ocean: You all are wealthy enough, he said, that you should raise $1 billion to return me to the White House. At the dinner, he vowed to immediately reverse dozens of President Biden’s environmental rules and policies and stop new ones from being enacted, according to people with knowledge of the meeting, who spoke on the condition of anonymity to describe a private conversation.

And in case you were wondering if Trump was simply making vague overtures toward industry leaders who follow the same train of thought he does—i.e., it would be ideal to stay out of prison until, say, 2040, when people start committing grisly crimes for the air conditioning—his offer went even further.

The Washington Post reported that according to those Mar-a-Lago attendees, Trump said the it would be a “deal” for those Big Oil executives because of all the taxes and regulations they’d be spared under another Trump presidency.

Uh-huh. In case you were wondering, this isn’t the way the government is supposed to work. It often does, unfortunately, but rarely are the nihilistic cockwombles quite this cocky.

Of course, while a Trump promise is usually worth less than the sallow flap of neck skin his prison tattoo will eventually be printed on, you can rest assured he’d keep this one. For one thing, he wants that money spigot to stay open. For another, he hates anything that might save the planet and/or muss his golden tresses. And, well, he’s not exactly a policy maven so much as a clean slate that anyone with a couple billion dollars can write on like a yard sale Etch A Sketch.

And that’s exactly what the fossil fuel industry is doing. They’re not waiting around for Trump to complete his comprehensive energy plan—which will be available approximately two weeks after his interns are done scrubbing out the puzzling Hitler references. They’re anticipating a future Trump presidency now

As Politico reported:

The U.S. oil industry is drawing up ready-to-sign executive orders for Donald Trump aimed at pushing natural gas exports, cutting drilling costs and increasing offshore oil leases in case he wins a second term, according to energy executives with direct knowledge of the work.

The effort stems from the industry’s skepticism that the Trump campaign will be able to focus on energy issues as Election Day draws closer—and worries that the former president is too distracted to prepare a quick reversal of the Biden administration’s green policies. Oil executives also worry that a second Trump administration won’t attract staff skillful enough to roll back President Joe Biden’s regulations or craft new ones favoring the industry, these people added.

And you should remember this excerpt in four years when you’re squatting in an ice bucket in northern Alaska, celebrating Earth Day by watching oil refineries explode:

The Biden policies they would seek to unravel include a new fee on leaks of the potent greenhouse gas methane from oil and gas equipment on federal land. The industry also wants to change an Environmental Protection Agency risk management rule focused on preventing refinery accidents, [Stephen] Brown [ director of energy consulting firm RBJ Strategies and a former refining industry lobbyist] said.

All this is particularly sad considering the clear benefits of Biden’s green infrastructure initiatives, which Trump would no doubt seek to roll back out of ignorance, spite, love of money, and a presumed hatred of narwhals. In fact, a little more than a week ago, the Biden administration “released rules designed to speed up permits for clean energy while requiring federal agencies to more heavily weigh damaging effects on the climate and on low-income communities before approving projects like highways and oil wells,” according to The New York Times

Does anyone think a second Trump administration would prioritize desperately needed clean-energy projects? Trump would strip everything out of Biden’s infrastructure laws he doesn’t like and claim sole credit for the rest. It’s what Republicans do, after all.

And as we all recall, while cosplaying as president, Trump thought the best remedy for a burning planet was raking forests, pulling us out of the Paris climate agreement, and swapping humid Puerto Rico for a still-somewhat-icy Greenland. He knows he’ll die sometime in the next 20 years anyway, and unless they can put him in cryogenic freeze until science comes up with a cure for spontaneously dying on the toilet, immortality is out of reach. So what does he care?

Meanwhile, to the extent that Trump cares about policy at all, he’s proposing actions that would make post-pandemic inflation—which has bedeviled every nation on the planet—permanent. These include enacting disruptive tariffs, cutting rich people’s taxes, and deporting willing workers.

All that would hurt ordinary Americans to the benefit of plutocrats, but then, Trump is nothing if not a phony populist. As CNBC reports, Trump is currently fielding calls from wealthy donors who are keenly invested in who Trump should—and, perhaps more importantly, should not—choose as his running mate.

“I would imagine some of Trump’s trade agenda is pretty concerning for many donors,” said Marc Short, Mike Pence’s chief of staff, “and they would hope for someone there to offer a different perspective to a 10% tariff across the board.”

Other Trump donors don’t particularly care for Ohio Sen. J.D. Vance because of his support for higher tariffs and what CNBC called “aggressive business regulation.

Well, as the old saw goes, you got to dance with them what brung you, and it’s clear Trump is dancing for dollars—when he’s not fixing to jitterbug his way out of jail.

F#@k the planet.  F#@k civilization.  Just give me that billion dollars, baby!

ENOUGH!!! Samuel Alito's flag is upside down. So is the Supreme Court

WASHINGTON, DC - JULY 23: U.S. Supreme Court Justice Samuel Alito is seen after a swearing in ceremony for Mark Esper to be the new U.S. Secretary of Defense July 23, 2019 in the Oval Office of the White House in Washington, DC. The Worst Supreme Court Justice.  Is it "Coke Can" Clarence Thomas or is it this reprehensible dude Samuel Alito?  Good news: you get two votes. They are both totally corrupt and compromised.

By Mark Sumner

Daily Kos Staff

The New York Times reported on Thursday evening that an upside-down American flag was seen flying over Justice Samuel Alito’s home in the weeks following the Jan. 6 assault on the Capitol. The inverted flag—historically, signifying an emergency—became a symbol for Donald Trump supporters who wanted to overturn the 2020 election.

Images show the flag flying at Alito’s home on Jan. 17, while the Supreme Court was considering whether to hear a case involving results of the 2020 election.

Alito is blaming the pro-Trump flag on his wife. In an email statement to the Times, Alito wrote, “I had no involvement whatsoever in the flying of the flag. It was briefly placed by Mrs. Alito in response to a neighbor’s use of objectionable and personally insulting language on yard signs.”

The sign in the neighbor’s yard was reportedly an “anti-Trump” sign. While there is reporting that Martha-Ann Alito argued with neighbors over the sign, there’s no indication that it included language personally attacking her or her husband. Even if it had, that wouldn’t validate a Supreme Court justice making a clear signal of political preference on issues before the court.

How long Alito flew the flag isn’t clear, though it was there for several days, according to one email the Times reviewed— but judicial experts consulted by the Times say that this was a “clear violation of ethics rules.”

In a September 2021 appearance with a right-wing podcaster, former Trump campaign attorney Sidney Powell outlined how Alito was supposed to play a role in a last-minute legal effort to block the counting of electors.

“We were filing a 12th Amendment constitutional challenge to the process that the Congress was about to use under the Electoral Act provisions that simply don’t jibe with the 12th Amendment to the United States Constitution,” said Powell. “And Justice Alito was our circuit justice for that.”

That case wasn’t filed weeks in advance. It was filed while insurrectionists were swarming the Capitol. And it appears that only the steadfast action of House Speaker Nancy Pelosi in bringing Congress back to order and completing the count that evening may have prevented Alito from delaying the confirmation of Joe Biden’s victory.

The case before the court while Alito was signaling his support for Trump involved counting of mail-in ballots in Pennsylvania. The state Republican Party originally brought its application for a stay of a state Supreme Court decision to Alito in October, but Alito, joined by Justices Brett Kavanaugh and Clarence Thomas, denied the request to hear the case before the election. Four days after the election, Alito issued an order requiring that the state segregate late-arriving mail-in ballots to await the Supreme Court decision.

Though the U.S. Supreme Court ultimately allowed the ballots to be counted, Alito, along with Kavanaugh and Thomas, voted against the ruling and wrote dissenting opinions.

This isn’t the only time that Martha-Ann Alito was in the middle of an issue before the court. In 2023, she leased land to an oil and gas company, collecting between $100,000 and $250,000, just a month after her husband wrote the majority opinion in a case that radically scaled back the enforcement powers of the Environmental Protection Agency and opened more land to oil and gas drilling.

Like Thomas, whose wife was directly involved in Jan 6. events, Alito isn’t just conservative; he’s committed to eroding government power to help his billionaire friends. Any pretense that Alito has a judicial philosophy in election matters other than helping Trump is exactly that—pretense.

Rather than interpreting the law and the Constitution, the Supreme Court has become part of the process of destroying both, most recently by saving Trump by agreeing to hear his request for  immunity. In that case, Alito and other conservative justices made it clear that they weren’t about to let something as trivial as the facts stand in the way of providing a ruling that gives Trump what he needs.

“I’m not discussing the particular facts of this case,” Alito said during oral arguments.

“I’m not concerned with this case,” Neil Gorsuch said.

“I’m not focused on the here and now of this case,” Kavanugh chimed in.

As it turns out, an upside-down flag still signals an emergency. In this case, it’s a whole nation under threat from Supreme Court justices putting their support for Trump above the law.
